Conditions of USE Agreement 

I hereby request permission to examine/use the manuscripts, photographs, or other materials listed below for the following purpose (a specific statement is required):

     I understand that permission to examine a manuscript or photograph, if granted, does not include permission to publish the contents of the manuscript, photograph, or any excerpt there from, at any time. Permission to publish, or otherwise publicly use, must be specifically indicated below by a designated employee [Coordinator of Special Collections/University Archives] of Ramsey Library, as to the manuscript, excerpt, oral history, or photograph, to be used. I agree to abide by the designated employee's decision.   
     I understand further that the University makes no representation that it is the owner of the common law copyright or literary property in any unpublished manuscript or photograph, and that wherever applicable, permission to publish must also be obtained from the owner of the copyright (the owner or his transferees, heirs, legatees, or literary executors). If this application includes a request for reproduction of any photograph, manuscript, or excerpt listed below, I agree that the reproduction is to be made solely for the purposes indicated. The reproduction will not itself be reproduced or transferred to any other person or institution.
     In consideration of my being granted permission to examine or reproduce any photograph, manuscript, or excerpt on the terms set forth hereby, I agree to indemnify and hold harmless the University, its officers, employees, and agents from and against all claims made by any person asserting that he/she is an owner of the common law copyright or literary property. 
     Permission is hereby given to the undersigned to use the following item(s), under the stated terms and conditions, provided that publication use credits the collection as follows (name of the collection):

It is preferred that users of materials come to Special Collections to review the material for use and to fill out the use agreement. It is acknowledged that many users will be unable to visit the Collection in person. For remote users of materials, it is requested that the above form be completed, signed, and mailed to Special Collections at the address below. The signed form may also be faxed to (828) 251-6012 or e-mailed to hwykle@unca.edu. A copy of the signed and authorized user agreement will be photocopied and returned to the user. By signing this agreement the applicant agrees to the following:

1. Applicant agrees to give credit for the image(s) or text(s). All relevant information regarding the image(s) or text(s) must accompany the citation. This includes the author, or photographer name, as well as the following credit line: [collection name #], D.H. Ramsey Library Special Collections, UNC Asheville 28804.

The credit line shall appear in the following manner:

• Printed material - Locate on the same page or adjacent to the image, or text.
• Films, filmstrips, video, or electronic media - Credit should be located where all other credit sources are located. If supplemental material accompanies the films, filmstrips, video, or electronic media, this must also carry the credit.
• Exhibition - Any exhibition of the image(s) or text(s) must display credit within the exhibition area. 
• Web use - Must include either embedded or attached credit in small (8 or 10 pt. type) to right or left or below image or text. Note, credits are not required in a streaming video context.

2.  Applicant agrees to use the image(s) or text(s) only one time or only for the purpose stated in the Use Agreement. If image(s) or text(s) are re-used in any manner, including photographing or electronic reproduction, this constitutes re-use and permission to reuse the image(s) or text(s) must be made in writing.  Subsequent use of image(s) or text(s) generally requires an additional fee. 

3.  Applicant agrees to supply appropriate credits, sources and acknowledgements of use in addition to embedded or attached individual credit in all Web use. 

4.  Applicant agrees to assume responsibility for any questions regarding privacy or copyright violation that may occur from the use of the image(s) or text(s). Applicant agrees to assume responsibility for ALL rights clearance.

5.  Applicant agrees to disclose any intended commercial use of material.

6.   Applicant agrees to provide the University of North Carolina at Asheville a complimentary copy of any published printed material that contains the image(s) or text(s).
