THIS INDENTURE, made
this 16th day of Febuary in the year of our Lord on thousand eight
hundred and Forty two between Robert Thomas Esquire, High Sheriff of
the county of Henderson and State of North Carolina, on the one
part, and John [C?] Case of the county of Henderson and State
aforesaid, of the other part: Whereas, the PUBLIC, COUNTY and POOR
TAXES, to the amount of Ten dollars and 6/100 upon the land
hereinafter described, were due for the year 1840 and collectable by
the Sheriff aforesaid; as also the sum of [one?] dollars & [20?]/100
for contingent charges allowed by law. AND WHEREAS, the said Robert
Thomas Sheriff aforesaid, in pursuance and by virtue of his office
and the Acts of Assembly in such case made and provided, did seize
and take into his hands and custody, (no goods or chattels to be
found) a certain piece or parcel of Land, situate, lying and being
in said county of Henderson North Carolina and bounded as follows:
And the said Robert Thomas Sheriff as aforesaid, after due
advertisement according to law, did cause the said piece or parcel
of Land, with all the appurtenances thereunto belonging, to be put
up at public sale according to the Acts of Assemble which prescribe
the mode of selling Lands for the payment of Taxes, on the 16th day
of February in the year of our Lord one thousand eight hundred and
Forty one at which time and place the aforesaid John [C?] Case
became the last and best bidder, at One hundred & Forty Five Acres
of the said Land, with all appurtenances thereunto belonging, for
the said Taxes and contingent charges: which said One hundred &
forty five Acres are bounded as follows, to wit: Beginning at a [bl...?]
Joseph [Gilbert?] [?] corner on a [running?] with there line South
one hundred & fifty eight poles to a pine on the South side of a
ridge [l...?] Hill & I. [Wells?] & Myers [lo..?]; [th...] [next?]
Myers line west one hundred and Seventy nine poles to a stake &
[pointers?] in Myer's; Then North forty poles to a black oak on the
South side of a branch Millers corner; [Then?] with his line North
16. degrees East 160. poles to a stake & [pointers?] on [Myers?]
line; three with Myer's line East 188 poles to two black oaks in
John [T...pp?] & Myer's line; [Then?] South [?] pales to a stake & [pu...?]
Myers & [Gilbert?] line [?] with. [?] line to the [beginning?]. [?]
one hundred and forty Acres-
THIS INDENTURE witnesseth, That the said Robert Thomas Sheriff of
Henderson county, as aforesaid, for and in consideration of the said
sum of ten dollars & 6/100 to him in hand paid by the said John [C?]
Case at and before the sealing and signing of these presents, the
receipt whereof is hereby acknowledged, he the said Robert Thomas
Sheriff, doth hereby bargain, sell, alien, enfeoff, convey and
confirm unto the said John [C?] Case his heirs, executors,
administrators or assigns, forever, all the aforesaid Land,
tenements, appurtenances last aforesaid, with all the hereditaments
and emoluments to the same belonging, or in any wise appertaining,
to have and to hold to kin the said John [C.?] Case heirs,
executors, administrators or assigns, forever, in as full and ample
a manner as he, [the?] said Sheriff, is empowered by virtue of his
office. And further, the said Robert Thomas Sheriff, doth hereby
covenant, promise and grant, to and with the said John [C.?] Case
his heirs, executors, administrators or assigns, who shall and may
from time to time, and at all times hereafter, have, hold, occupy,
possess and enjoy the said [?] mentioned premises, with the
appurtenances, free and clear of and from all encumbrances had,
made, done or committed by him the said Sheriff or by his order,
means or procurement, and he the said Robert Thomas Sheriff, will
warrant and defend the same to the said John [C.] Case his heirs,
executors, administrators or assigns, forever, so far as his office
of Sheriff will admit, and no further.
In witness whereof, the said Robert Thomas Sheriff of Henderson
County have hereunto set my hand and seal, the day and year first
