This indenture made the 28th day of September one thousand eight hundred and sixty five between Isaiah Pain by Thos [Thomas] A Foster his lawful atorney [sic] of the County of Henderson and State of North Carolina on the [one..st?] and Isaiah Laughter of the County and State aforesaid on the other part Witnesseth that the said Isaiah Pain by T.A. Foster his atty [attorney] for and inconsideration of the sum of Eight-hundred dollars to him in hand paid by the said Isaiah Laughter his heirs and assign a certain piece or pieces or parcels of land in the County and State aforesaid on the waters of Hendersons Creek adjoining the [lands?] of J.C. Case and Joseph Taylor & others bounded as follows- Beginning [?] on Chestnut John Grays & Taylor's corner & runs East {to?] Grays line 21 po [+?] 2 ft to a [?] in sd [said] line thence with a conditional line between sd [said] Taylor [?] Pain passing a persiminon [persimmon] tree 42 po to a stone a conditional corner thence [...ly?] west 24 po to a Sourwood in the old line thence South with the old line to the Beginning containing 5 Acres more or less 2nd tract Beginning on a [?] & runs North 80 [degrees] East 481/2 po to a stake thence South 11 poles to a stake [thence?] South 80 [degrees] West 481/2-po to a stake [at?] Pains & J.C Cases Corner on sd [said] Gray's line[.] thence North with sd [said] line 19 poles to the beginning containing five Acres & 3 fourths, 3d [third] tract Beginning on a Red oak J. Taylor & J.C. Case's corner & runs South 120 poles to a Road that runs by what is called the knotty pine thence with said road it being a dividing line agreed upon between the partied runs a North West course 88 poles to the knotty pine thence a North East course with or [?] branch that runs towards James Lannings and marked a conditional line made & agreed upon between the parties 100 poles to a stake & pointers in James Lannings & [J. N.?] King line thence East with sd [said] line 126 poles to 2 [spe...?] Oaks in sd [said] line thence Sout [South] 30 poles to a Stake & painters in J. Taylors line thence west 102 poles to the beginning containing 62 Acres more or less to have and to hold the said lands and premises and all and singular the tenements hereditaments woods ways waters mines minerals improvements rents issues profit remainders reversions privileges and [appe...?] thereunto belonging or in anywise appertaining to him the sd [said] Isaiah laughter his heirs and assigns to his and their own proper use and behoof in fee simple forever And the sd [said] Isaiah Laughter his heirs and assigns shall and will warrant and forever defend from the lawful claim or claims of any and all person whosoever And lastly the said Isaiah Pain by T.A. Foster atty [attorney] for himself his heirs executors and administrators hath covenanted & agreed and by these presents doth covenant & agree to & with the sd [said] Isaiah Laugher his heirs and assigns [?] the sd [said] Isaiah Pain by T.A. foster, atty, is now at the time of [executing?] [?] presents seized of a good [?] and indefeasible estate of inheritance in the aforesaid lands and [p....?] and that he hath full power and lawful authority to convey the same in manner and [form?] aforesaid and that the said Isaiah Laughter his heirs and assigns shall henceforward have & hold peacable [peaceable] [po....?] and quiet enjoyment of the same [?] from any & all Judgments executions leased [mortgages?] trusts [?] dower rights and all other incumberances heretofore [accr..d?] or suffered by the sd [said] Isaiah Pain or any other person for him in his right or by his procurement
