This indenture made this the 16th day of December A.D. 1857 between John Gray of the County of Henderson and State of North Carolina of the first part and Isiah Pain of the County and State aforesaid of the second part. Witnesseth that the said John Gray of the first part for and in consideration of the sum of twenty five dollars the receipt of which is hereby acknowledged as given granted bargained and sold and conveyed to the said Isiah Pain his heirs and assigns all that tract or parcel of land lying in the county and State aforesaid bounded as follows. Beginning on a chestnut tree and runs North 80 East 48 1/2 poles to a Stake thence south 19 poles to a stake thence South 80 west 48 1/2 poles to a stake thence, Pains and J.C. Cases'(?) corner on the said Grays Line thence North with said line 19 poles to the beginning. Containing five acres and three quarters to have and to hold to the said Isiah Fain(?) with the appurtenances thereunto belonging to horn(?) these, Fain his heirs and assigns forever and the said John Gray for the conrid(?) location(?) aforesaid does covenant and agree to warrant and for ever defend the right and title of the aforesaid land to the said Isiah Fain(?) his heirs executors administrators and assigns against the claim of any person whatsoever.
