This [Indendure?] is
made and confirmed this 5th day of August one thousand eight hundred
and twenty eight between Robeson Freeman and Jay W. Freeman both of
North Carolina Rutherford county. Witnesseth that the said Robeson
Freeman hath bargained and sold and by these presents do bequeath
and sell unto the aforesaid Jay S. Freeman for the consideration of
the sum of one hundred dollars to him in hand paid by the aforesaid
Jay W. Freeman a certain tract or parcel of lands by Estimation one
hundred acres be the [size] more or less lying and lays on the
County of Rutherford on the side of the [Round?] [Loft?] mountain on
[Trout?] River Granted to Jesse Brigs and [Donald?] Miller by his [excellency?]
the Governor of the state Samuel Ashe in the year of our Lord one
thousand seven hundred and ninety six, the twentieth day of
December.
Beginning at a white [fir?] on the north Bank of the river thence
North 88 degrees East ninety poles to a chestnut thence south 82
degrees East one hundred and eighty poles to a stake thence south
and west go poles to a stake on the bank of the river thence up the
river to the beginning to have and to hold to the said Jay W.
Freeman, his heirs and assigns forever, all [words?], [unknown] and
every [benefit?] that may arise from [S...?] land, and the aforesaid
Robeson Freeman, for himself his heirs and assigns do bargain and
sell, unto the aforesaid Jay W. Freeman his heirs and assigns and by
these presents do warrant and defend the aforesaid land, unto Jay W.
Freeman his heirs and assigns forever, in witness whereof he hath
hereunto set his hand, and affixed his seal this day and year first
above written, signed sealed and delivered in the presents of the
witnesses.
