This indenter [sic] Made this seventh of February in the year of our
Lord one thousand eight hundred & twenty three between David Briggs
of the County of Rutherford & State of North Carolina of the one
part & Robeson Freeman of the County & State aforesaid of the other
part. Wittnesseth that for and in consideration of the sum of fifty
dollars Good & lawful money of the State Sd [said] to me in hand
paid by the Sd [said] Robeson Freeman before the sealing and
delivering of these presents the recipt and payment wheare [sic] of
I do hearby acknowledge that I have granted bargind [sic] sold &
convaid [sic] & confinnd & by these presents Doth grant bargin sell
convay & confirm unto the Sd [said] Robeson freeman his heirs &
assigns forever one certain tract of land containing one hundred
acres granted to Jesse Briggs & David Miller by his exelancey [sic]
the Governor of the State Sd [said] Sam Ashe in the year of our Lord
one thousand Seven hundred & ninety Six and twentieth Day of
December being in the County of Rutherford on the side of the round
top mountain on Broad River Beginning at a white oak on the north
bank of the river thence North & East ninety poles to a chestnut
thence South & 2 East one hundred an [sic] Eighty poles to a stake
thence South & West 90 poles to a stake on the band of the river
thence up the river to the beginning containing one hundred acres
with the appertainences situate Lying and being as affore [sic] Sd
[said] to have and to hold all and everry [sic] of the
affore Sd one hundred acres of land with the appertainences [sic]
thare unto belongings in any wise apertaining [sic] to the only use
and behoof of the afore Sd Robeson freeman his heirs an assigns
forever and of the Sd David Briggs for my self my heirs and
succesors [sic] Doth hearby Covenant and agree to and with the afore
Sd Robeson freeman that the Sd David Briggs his heirs executors and
administrators shall at all times warrant & forever defend the afore
Sd Granted primises [sic] to the Sd Robeson freeman his heirs and
assigns forever against all lawful ____ or demands that ever wharebe[?]
the above mentioned primises [sic] might or or may be affected or
any wise incumberce [sic] contrary to the true intent and meaning of
these presents in witness whearof I have hearunto set my hand
affixed my Seal the Day and year first above written Signed Sealed
and Delivered in the presents of us the witness
