above named, if they be found within your County, to be and appear
before thr [sic] Judge of your Superior Court, at a Court to be held for
the County of Henderson, at the Court House in Hendersonville, on the
fourth Monday after the 1st Monday in September 1906, and answer the
complaint which will be deposited in the office of the Clerk of the
Superior Court of said County within the first three days of the Term,
and let said defendants take notice that if they apply to the Court for
the relief demanded in the complaint, and the cost of this action to be
taxed by the Clerk.
Herein fail not and of
this summons make due return.

We acknowledge
ourselves bound unto David A. Thompson, Geo. Willett Van Ness, and Wm.
Redmond Cross, the Defendants in this action, in the sum of Two Hundred
Dollars, to be void if the Plaintiff, E.B. Harris, shall pay to the
Defendants all such costs as the Defendant may recover of the Plaintiff
in this action.
