Sirs:
I am in receipt of yours of the 5th Inst. [a previous
letter] referring to the J M Stephenson matter. As to the affidavit
of C L. Miller he took the date that the Commercial Bank commenced
business which was in the 1900- and of course could not testify to
anything in 1896. The 78 acres to which Mr. Stephenson refers to, is
no part of the 339 acres neither is it any part of the 98 acres as
you will observe by examination of the enclosed plats of survey made
by Mr. Biggers. In reference to the Phillip and E. W. Helms
contracts the facts are as follows. There was a contract including
the land lying on the West side of the Green strip of 6 acres
extending from the Northern boundary of the 333 acres up to the old
Charlotte road & east of the same Green strip of 6 acres & north of
the line of the 333 acres_&North of the 98 acre tract, the 50 acres
including the 6 acres & the 78 acres making a total of 134 acres as
