This Indenture made and confirmed this sixth day of November AD 1838 between Charles Gilliam of the county of Rutherford State of North Carolina of the first part and Joshua Forman, of the same county and State, of the second part. Witnesseth, that the said Charles Gilliam for and in consideration of the sum of Two Hundred & Seventy three Dollars to him in hand paid by the said Joshua Forman the receipt whereof is hereby acknowledged hath bargained and sold, and by these presents doth bargain and sell to the said Forman his heirs executors & assigns, a certain piece or parcel of Land in the county of Rutherford situated on Main Broad River, Beginning at a White oak on the Bank of the River and runs N. 8[degrees] E [90?] poles to a chestnut-found Then S. 82[degrees] E [90?] poles to a stake on the Branch Hunkler's corner, then with his line down the Branch as it meanders, nearly South 20 W. [90?] poles more of less to a stake his corner where said Branch [mouth?], in Broad River, then up the River nearly North 80 W. 84 poles more or less to the beginning, containing Forty nine acres more or less, to have and to hold, with all the hereditaments and improvements thereunto belonging, unto the said Joshua Forman, his heirs and assigns forever, and the said Charles Gilliam doth hereby agree and bind, himself, is heirs and assigns, to warrant and defend the said Joshua Forman, his heirs and assigns, against all claims in said land.
