Lewis Scoggins Bond of Indemnity
We the undersigned acknowledge ourselves[?] indebted to John Ward and J.J.
Hoyt makes[?] _ in the sum of four hundred dollars for the which payment
will & truly to be made we bind ourselves our heirs executors and
administrators jointly s___y[?] frinby[?] by those presents signed sealed
& dated thins 31st day of May AD 1854.
The audition of the
alm obligation is such that whereas the above bounded Lewis Scoggins hath
brought suit in the Superior court of Law of Rutherford county in the
reasons[?] of John Ward & [??] J. Hoyt partners [?] & against T.J.
Blanton in being in action of Ejectment for on Order[?] of the above names
trustees plaintiffs or J'ai[?] & said Blanton defendant view[?] if the
said Scoggins shall[?] presencets[?] said nil[?] & ran harmey[?] the
said Ward & Hoyt have alm[?] costs their taxes[?] above bond t_[?]
said, whenever to be of use[?] force and virtue[?]. The above named Ward
& Hoyt trustees having given permission to use their names as lessors[?]
to inable[?] the ruined[?] Scoggins to recover possession of land claimed
under them, upon condition of his having[?] them from all costs and
charges. signed & naew[?] day & date of above[?].
