Letter
from C. B. Justice to Bro. Smith (William Smith, Attorney), dated
April 23, 1907. The letter concerns the need for a legal opinion
regarding 36 acres sold on the waters of Big Hungary and P___ Creeks
of the Green River. The heirs of the owner sold the land and made a
Deed calling for the center of the River as a boundary, which the
original Deed did not call for. "Can the new owner hold it, and if
not how are we to get rid of him? Also a similar problems exists
concerning a 50 acre tract on the Green River that the owner
defaulted on and, in 1903 another party paid the balance due and now
claims a boundary to the center of the River. Can we confine this
individual to the South side of the River?" Signed by C. B. Justice.
Included in the letter are surveys of the tracts.

Dear [Bro?] Smith:
Please give me an opinion at once on those two matters. It
is an urgent case and I need the opinion immediately[.] 1st we
originally sold to [Jas?] Jones or H.K. Jones 362 acres of land on
waters of Big Hungry & Pollams creek of Green River which begins at
Poplar at the mouth of Pullams Creek and runs [various?] crosses up
Pullmans Creek and around to Big Hungry and then down the creek to a
[post?] at the mouth of Big Hungry in the north bank of Green river
then down the river to the beginning-It seems that the first and
last corner of their tract are in the north side of the river. Now
will the [closing?] line run with the north bank of the river, or a
straight line or how? 2. Some of the Jones heirs have sold to J.M
Lawrence a part of their land and, as I understand, have made him a
deed calling for the center of the river, which the deed to Jones
does not call for. As I am informed Lawrence claims under the deed
to him to the center of the river. Can he hold it? If not how are
we to get rid of him?
