Letter
from C. Bayliss Justice to William A. Smith, Attorney, dated June 8,
1908. In this letter he refers to his Power of Attorney from the
Trustees, and states that he has been their agent for more than 50
years. He also states that he will take this matter to the Supreme
Court if necessary to determine his right to act for the Trustees.
He also states that there have been a dozen suits like this.

This I wish to and must avoid if it its at all possible. If at the next
term of Court the judge should hold against us then appeal to the
Supreme Court in that point, without involving any other question
involved
in the case and settle the
question matter once for
all. If something of this sort cannot be done I may find it necessary to
remove the case to the Federal Court which I would regret.
If it is necessary to have the enclosed Power of Att. Registered in
Henderson County please give it to the Clerk with instructions to have
it registered, taking his in the Register's recpt [recipt] for it with
instructions to notify me, including bill for same, when it is ready to
be returned to me
It may be that I will be in Hendersonville in the course of ten days
