Any display, publication, or public use must credit the D.H. Ramsey Library, Special Collections, University of North Carolina at Asheville. Copyright retained by the creators of certain items in the collection, or their descendents, as stipulated by United States copyright law.  

The user understands that permission to examine a manuscript or photograph, if granted, does not include permission to publish the contents of the manuscript, photograph, or any excerpt therefrom, at any time. Permission to publish, or otherwise use, must be specifically requested from Special Collections/University Archives staff of Ramsey Library, or directly from the owner of the material, if so stated. 

The user understands further that the University makes no representation that it is the owner of the common law copyright or literary property in any unpublished manuscript or photograph, and that wherever applicable, permission to publish must also be obtained from the owner of the copyright (the owner or his transferees, heirs, legatees, or literary executors). If the user requests reproduction of any photograph, manuscript, or excerpt, they agree that the reproduction is to be made solely for the purposes agreed. The reproduction will not itself be reproduced or transferred to any other person or institution. 

In consideration of  being granted permission to examine or reproduce any photograph, manuscript, or excerpt on the terms set forth hereby, the user agrees to indemnify and hold harmless the University, its officers, employees, and agents from and against all claims made by any person asserting that he/she is an owner of the common law copyright or literary property. 

Further, materials which may be sensitive or confidential may be protected by federal and/or state right to privacy laws and regulations.  Consultation of the North Carolina Public Records Act, (N.C.G.S. - 132 1 et seq.) and the later Article 7 of North Carolina's State Personnel Act (Privacy of State Employee Personnel Records, N.C.G.S. - 126-22 et seq.) is advised for information about any persons currently living who may be represented in the collections.  This "sensitive materials statement" is intended as informational and does not carry any legal responsibility for the University of North Carolina Asheville.  All attempts have been made to protect the rights of individuals represented in our collections who may still be living.  [Please advise us of any information not already in the public domain that is believed to be sensitive, or offensive and that is not in the best interest of individuals now living,  and that possibly should not be shared. ]
